1) Agreement to Terms

These Terms & Conditions (“Terms”) govern your access to and use of JetStreamMX LLC’s websites and related online services (collectively, the “Site”).

“Company,” “JetStreamMX,” “we,” “us,” and “our” mean JetStreamMX LLC, a Connecticut limited liability company with its principal office at 24 Bodyk Place, Shelton, CT 06484. “You” and “your” mean the individual or entity accessing or using the Site.

By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, do not use the Site. Users must be at least 18 years old to use the Site. If you access or use the Site on behalf of a business or other entity, you represent that you have authority to bind that entity to these Terms.

2) Who We Are & Service Scope

JetStreamMX LLC provides on-site/mobile AOG maintenance, diagnostics, troubleshooting, and return-to-service (“RTS”) documentation services for business and corporate aviation. We primarily support Part 91/135 operators, flight departments, FBOs, and maintenance controllers across our Northeast U.S. service area.

Regulatory compliance is central to our operations:

JetStreamMX LLC maintains an FAA Drug & Alcohol Testing Program registration (Contractor) under registration number CONN562E, with current program dates on file.
JetStreamMX LLC is a U.S. business taxpayer with a valid IRS Employer Identification Number (EIN).

Actual maintenance work is not governed by these Site Terms. When a Work Authorization or service order is executed, the Work Authorization and its incorporated “Terms and Conditions of Company” control the specific job, pricing, lien rights, warranty, and other service-related terms.

3) Intellectual Property

All content on the Site—including text, logos, graphics, icons, images, page layouts, and software—is owned by JetStreamMX LLC or its licensors and is protected by U.S. and international intellectual property laws.

You may view and print reasonable portions of the Site for your internal business use only. Any other use—including copying, reproducing, scraping, framing, modifying, distributing, publicly displaying, or creating derivative works—requires our prior written consent.

Nothing on the Site grants any license or right to use any JetStreamMX name, logo, or trademark without our prior written permission.

4) Acceptable Use

You agree not to:

Misuse the Site or attempt to probe, scan, or test the vulnerability of any system or network, or breach security or authentication measures.
Interfere with or disrupt the operation of the Site or any related networks or systems.
Use any automated means (including bots, spiders, or scrapers) to access the Site or harvest data from it, except as expressly permitted by us in writing.
Post, transmit, or otherwise make available any unlawful, harmful, defamatory, infringing, or otherwise objectionable content through the Site.
Reverse-engineer, decompile, disassemble, or attempt to derive the source code of any software used to provide the Site, except to the limited extent expressly permitted by applicable law.
Use the Site in violation of any applicable law, regulation, or aviation safety requirement or in a manner that could reasonably be expected to interfere with safe operations.

We may monitor Site use for security, operational integrity, and compliance with these Terms.

5) No Professional Advice / Operational Reliance

Information on the Site is provided for general informational purposes only. It:

Does not constitute formal maintenance instructions, engineering data, or regulatory compliance guidance; and
Is not a substitute for current, applicable technical publications and certified personnel judgment.

Operational and maintenance decisions must be based on:

OEM instructions and technical publications (e.g., AMMs, service bulletins, ADs, MELs);
Applicable regulations; and
Qualified, certificated personnel.

Any quotes, timelines, availability statements, or service descriptions on the Site are estimates only and do not constitute binding offers unless expressly stated in a written Work Authorization or service agreement.

6) Work Authorizations, Pricing & Payment (Summary)

The Site provides general information about our services. Actual maintenance services are governed by:

The executed Work Authorization, and
The “Terms and Conditions of Company” incorporated into that Work Authorization.

Those documents set forth, among other things:

Labor rates, after-hours/holiday rates, and minimums
Travel, per diem, and standby charges
Parts handling, consumables, and surcharges
Taxes, fees, and other pass-through charges
Payment terms, delinquency/late charges, and collection costs
Lien and possessory rights in aircraft, parts, and records
Warranty limitations and disclaimers
Cancellation, no-show, and rescheduling terms
Dispute resolution mechanisms and venue

If there is any conflict between these Site Terms and a signed Work Authorization (and its incorporated terms), the Work Authorization and its incorporated terms control for that specific job or engagement.

7) FAA & DOT Testing Compliance (Contractors)

When JetStreamMX LLC is engaged as a contractor to perform FAA/DOT safety-sensitive functions (e.g., under agreements with Part 121 or Part 135 certificate holders), we implement and follow an FAA-mandated Drug & Alcohol Testing Program in accordance with 14 CFR Part 120 and 49 CFR Part 40.

Program registration: CONN562E (Contractor).
Program effective and expiration dates are maintained according to FAA Drug Abatement Division guidance and are available for verification upon legitimate request.

Nothing in these Site Terms modifies any regulatory requirement or operator-specific program obligations.

8) Credentials & Documentation

JetStreamMX LLC utilizes FAA-certified A&P technicians and other qualified personnel with relevant type and systems experience and training, as applicable to the services performed. We maintain documentation such as:

FAA airman certificates and ratings
Recurrent and type-specific training records
Relevant experience and qualification documentation

Representative credentials and documentation can be made available to customers or regulators for due diligence, audits, or compliance verification upon reasonable request.

9) Privacy

Your use of the Site is also governed by our Privacy Policy, which explains:

What personal and business information we collect
How we use and share that information
How we protect information
Your options and rights (e.g., access, correction, deletion, or opt-out, as applicable)

By using the Site, you consent to our data practices as described in the Privacy Policy. If there is any inconsistency between these Terms and the Privacy Policy regarding data use, the Privacy Policy controls as to data-handling practices.

10) Disclaimers

THE SITE AND ALL CONTENT MADE AVAILABLE THROUGH IT ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, JETSTREAMMX LLC DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO:

IMPLIED WARRANTIES OF MERCHANTABILITY,
FITNESS FOR A PARTICULAR PURPOSE,
TITLE, AND
NON-INFRINGEMENT.

Without limiting the foregoing, we do not warrant that:

The Site will be uninterrupted, timely, secure, or error-free;
Any defects will be corrected; or
The Site or the servers that make it available are free of viruses or other harmful components.

Any reliance on information obtained through the Site is at your own risk.

Service-work warranties, if any, are governed solely by the applicable Work Authorization and its incorporated terms, not by these Site Terms.

11) Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, JETSTREAMMX LLC, ITS MEMBERS, MANAGERS, EMPLOYEES, AND CONTRACTORS WILL NOT BE LIABLE FOR ANY:

INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR
ANY LOSS OF PROFITS, REVENUE, DATA, USE, GOODWILL, OR BUSINESS OPPORTUNITY,

ARISING OUT OF OR RELATING TO YOUR USE OF (OR INABILITY TO USE) THE SITE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SITE WILL NOT EXCEED:

ONE HUNDRED U.S. DOLLARS (US$100), OR
THE AMOUNT YOU PAID (IF ANY) FOR ACCESS TO THE SITE IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM,

WHICHEVER IS GREATER.

Liability for maintenance or other services is governed exclusively by the applicable Work Authorization and its incorporated terms.

12) Indemnification

You agree to defend, indemnify, and hold harmless JetStreamMX LLC and its members, managers, employees, and contractors from and against any and all third-party claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to:

Your use or misuse of the Site;
Your violation of these Terms; or
Your violation of any applicable law or any third-party rights.

We reserve the right to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which case you agree to cooperate with us in asserting any available defenses.

13) Electronic Communications & Signatures

By using the Site, you consent to receive communications from us electronically, including emails, notices posted on the Site, and other electronic messages.

To the fullest extent permitted by law:

You agree that electronic signatures, click-through consents, and electronic records used in connection with our online forms, Work Authorizations, and other Site interactions have the same legal effect as handwritten signatures and paper records.
You waive any objection to the use of electronic form and delivery for notices and records related to your use of the Site.

14) Modifications & Site Availability

We may update, modify, or replace these Terms at any time. When we do, we will update the “Last Updated” date at the top of this page. Changes become effective when posted on the Site, unless a later effective date is stated. Your continued use of the Site after changes are posted constitutes your acceptance of the revised Terms.

We may also, at any time and without liability:

Suspend, restrict, or discontinue all or any part of the Site; or
Restrict access to the Site for maintenance, security, operational reasons, or for any other reason we deem appropriate.

15) Governing Law; Venue

Except where a signed Work Authorization or separate written agreement expressly specifies otherwise, these Terms are governed by the laws of the State of Connecticut, without giving effect to its conflict-of-law principles.

You agree that the exclusive venue and jurisdiction for any dispute arising out of or relating to these Terms or your use of the Site will be the state and federal courts located in Fairfield County, Connecticut, and you consent to the personal jurisdiction of those courts.

16) Dispute Resolution

Before filing a lawsuit or similar proceeding, the parties agree to use reasonable, good-faith efforts to resolve disputes informally, including through direct discussions between authorized representatives.

If a dispute cannot be resolved informally:

Either party may proceed in the courts identified in Section 15 (unless a different forum is specified in a Work Authorization or other written agreement).
If a Work Authorization or written service agreement requires arbitration or another dispute-resolution mechanism for specific disputes, that provision will control for those covered disputes.

17) Miscellaneous

Severability. If any provision of these Terms is found to be invalid or unenforceable, that provision will be enforced to the maximum extent permissible, and the remaining provisions will remain in full force and effect.
No Waiver. Any failure by JetStreamMX LLC to enforce a right or provision of these Terms is not a waiver of that right or provision. A waiver is effective only if in writing and signed by us.
Assignment. You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign these Terms, in whole or in part, to an affiliate or in connection with a merger, acquisition, corporate reorganization, or sale of assets.
Entire Agreement (Site Use). These Terms constitute the entire agreement between you and JetStreamMX LLC regarding your use of the Site and supersede all prior or contemporaneous understandings relating to Site use. They do not modify or replace any signed Work Authorization or service agreement, which controls the terms and conditions of any maintenance or other services.
Corporate Details. Our company name, address, and Connecticut governing-law provisions are confirmed in our organizing documents and any applicable registrations.
